ATOM provides subscription-based access to curated information on AI inference vendors, pricing, and related analytics. The service is intended for informational purposes only and does not constitute financial, technical, or business advice.
You agree not to:
ATOM and all Content are provided "as is" and "as available." Member One EOOD makes no representations or warranties of any kind, express or implied, including but not limited to accuracy, completeness, reliability, merchantability, fitness for a particular purpose, or non-infringement.
All decisions, actions, investments, or transactions made on the basis of information from ATOM are undertaken solely at your own risk. Member One EOOD disclaims all responsibility for any outcomes arising from reliance on the Content.
To the maximum extent permitted by law, Member One EOOD shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, revenues, business opportunities, goodwill, or data, whether arising in contract, tort, or otherwise, even if advised of the possibility of such damages.
Where liability cannot be excluded, the total liability of Member One EOOD shall not exceed the total amount paid by you for access to ATOM in the twelve (12) months immediately preceding the claim.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence.
These Terms shall be governed by and construed under the laws of Bulgaria, without regard to conflict of laws principles. For users outside the United States, disputes shall be subject to the exclusive jurisdiction of the competent courts of Sofia, Bulgaria.
If you are a resident of the United States: Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association, on an individual basis. You agree to waive any right to participate in a class action lawsuit, class-wide arbitration, or any consolidated or representative proceeding.
Member One EOOD may suspend or terminate your access to ATOM if you breach these Terms. Upon termination, your right to use the service ceases immediately.
ATOM may rely on third-party services such as hosting providers, payment processors, or analytics tools. Member One EOOD is not responsible for interruptions, errors, or damages caused by such third parties.
If offered, free trials or promotional access are provided "as is" and may be withdrawn or modified at any time without liability.
You agree to comply with all applicable export control and sanctions laws. ATOM may not be used in or by residents of countries subject to embargoes or sanctions under EU or U.S. law.
You agree to indemnify, defend, and hold harmless Member One EOOD, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of ATOM, your violation of these Terms, or your infringement of any rights of another party.
Member One EOOD shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, power outages, internet failures, cyberattacks, labor disputes, government actions, or force majeure events.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and Member One EOOD with respect to your use of ATOM and supersede all prior or contemporaneous agreements, communications, and understandings, whether oral or written.
You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without prior written consent from Member One EOOD.
Headings are provided for convenience only and shall not affect interpretation of these Terms.
These Terms are provided in English. If translated into other languages, the English version shall prevail in case of discrepancies.
We reserve the right to modify these Terms at any time. Updated versions will be posted on the ATOM website with an updated "Effective Date." Continued use after changes constitutes acceptance.
